US Representatives Mike Flood and Wiley Nickel are urging the US Securities and Exchange Commission (SEC) to approve options trading on spot bitcoin exchange-traded products (ETPs), emphasizing the need to address the delay in the approval process.
Flood and Nickel have directed their concerns to SEC Chair Gary Gensler, highlighting the importance of clarifying the perceived discrepancy in treatment between options for Bitcoin futures ETFs, which are already trading, and options for spot Bitcoin ETPs.
Reasons for Approval Request
The lawmakers referenced the SEC’s January approval of spot bitcoin ETFs, noting the substantial influx of investment these products have garnered since their introduction. They emphasized the urgency of approving options on spot Bitcoin ETPs or providing a transparent explanation for the differing treatment between options for Bitcoin futures ETFs and spot Bitcoin ETPs.
The delay in approving options on spot bitcoin ETFs has raised concerns among lawmakers, especially considering previous court rulings that questioned the SEC’s rationale for treating similar products differently. Flood and Nickel underscored the importance of options trading for the investors whom the SEC aims to protect.
Historical Context
The eventual approval of spot bitcoin ETFs earlier this year followed a ruling by three judges in a D.C. court over the summer, which mandated the SEC to re-review Grayscale’s bid for a spot bitcoin ETF. The asset management firm had sued the agency after its plan to convert its flagship GBTC fund was initially rejected.
Flood and Nickel’s letter highlighted the critical role options trading plays in providing investors with risk management tools and additional investment strategies. While the SEC’s approval process typically involves multiple agencies, including the Commodity Futures Trading Commission (CFTC), the lawmakers focused on the SEC’s role in addressing the current regulatory challenges surrounding options trading on spot bitcoin ETFs.
SEC’s Review Process
The SEC has extended its decision-making timeline regarding options trading for Bitcoin ETFs proposed by Grayscale and Bitwise. While consultations regarding a proposed rule change indicate a potential shift in regulatory stance, multiple exchanges seeking to enable options trading on recently approved spot bitcoin ETFs have faced delays.
The SEC’s extended review aims to thoroughly assess the impact of introducing Bitcoin options trading on market stability and efficiency, particularly during volatile periods. The Commission also evaluates whether current surveillance and enforcement measures are sufficient for managing the complexities of Bitcoin options.
The SEC’s cautious approach to regulating crypto-related financial products is evident in its decision to set May 29, 2024, as the new deadline for a decision, following a previous postponement in March 2024. This reflects the SEC’s thorough review process and its commitment to ensuring robust oversight of crypto-related financial products.
